1. Preamble

The service is published by the Groupement d’intérêt public (GIP) "Pix", approved by decrees of April 27, 2017, and April 5, 2022, approving the founding agreement of the Groupement d’intérêt public "Pix".

The Pix platform provides access to an online service for the assessment, development, and certification of digital skills, with the objective of supporting the overall improvement of digital knowledge and competencies, and preparing for the digital transformation of society and the economy.

The Pix platform is accessible in particular at the following URLs: https://pix.fr and  https://pix.org.

The user wishing to access and use the platform must have previously and fully read these general terms of use.

They are intended to constitute the rule that every user must follow when visiting the platform or using the services.

2. Definitions

The terms defined below shall have the following meaning between the parties:

  • "general terms of use": these general terms of use for the Pix platform;
  • "informational content": all texts, photos, illustrations, and links, excluding test content;
  • "test content" or "tests": the tests (questions, instructions, illustrations, downloadable documents, list of valid answers, etc.);
  • "data": all types of information provided by the organization and/or users under their sole responsibility, hosted by GIP Pix and intended to be processed in the course of providing the services;
  • "user account": the space created by the user with their username and password, enabling access to the services;
  • "login credentials": the username and password provided by a user personally and confidentially when creating a user account, enabling access to the services from a secure connection;
  • "Pix platform": refers to the site as defined below as well as the public platform for the assessment and certification of digital skills based on an IT infrastructure composed of interfaces, database(s), server(s), and accessible online in SaaS mode. Its source code is governed by the GNU GPL V.3 free license;
  • "site": the Pix websites accessible in particular from the following URLs: https://pix.fr, https://pix.org, https://app.pix.fr and https://app.pix.org (including the subdomain https://pro.pix.fr );
  • "service" or "services": the Pix service(s) accessible online in SaaS mode, enabling the user to benefit from the features of the Pix platform, namely to assess their own digital skills, prepare for and take the Pix certification, have facilitated access to training content to develop their skills, and to be supported by a third party;
  • "user": any site visitor who does not have a user account or is not logged into their account, as well as any individual who has created a user account under the conditions set out in the “User Account” section and accesses the services;
  • "Pix Companion": software (browser extension) designed to make certain content appearing on search engines and certain websites unreadable by blurring or to block them, in order to assist the supervisor and limit cheating during Pix certification sessions.

3. Purpose

The purpose of these general terms of use is to set the conditions for the use of and access to the Pix platform and the site, accessible at the above addresses.

Accessing and using the Pix platform by the user implies that they have previously read and accepted the present terms.

4. Acceptance and Enforceability

4.1 Acceptance

The user may only use the Pix platform, benefit from the services, and browse the site subject to acceptance of these terms of use.

These terms of use are available and accessible to every user on the site.

Acceptance of these terms of use is formalized  in particular by clicking on the checkbox "I accept the Pix terms of use" by the user who creates their user account, after having reviewed these terms in full. This “click” and the associated technical log retained by Pix constitutes evidence that the user has taken note of these provisions and constitutes acceptance of the terms.

The user can save and print these terms of use using standard features of their browser or computer.

The user acknowledges that access to and use of the Pix platform and the services offered require compliance with all the provisions set out in these terms of use.

Additionally, users who take the Pix certification must have previously and fully read and accepted the general terms of use for the Pix Companion extension. The general terms of use for Pix Companion are available here.

4.2 Enforceability

These terms of use are enforceable against the user from the moment they are accepted during the creation of a user account or before any first access to the user account, through their access and continued presence on the site.

In all cases, as of the date of first use of their user account and access to the site, the terms of use are deemed to have been read and are applicable to the user.

GIP Pix reserves the right to make any changes it deems necessary and useful to these terms of use.

These terms of use remain enforceable as long as the user has access to and uses the Pix platform and until new terms of use replace these.

GIP Pix agrees to provide or make available to the user any new terms of use, informing the user of this as best as possible (notification, banner, etc.).

Any continued use without reservation of the user account by the user after such information, or acceptance by means of a checkbox after modification of the terms, constitutes acceptance by the user of the new terms of use.

The terms of use posted online on the Pix platform, including the site, prevail over any earlier printed version.

If the user decides to stop accessing and using the Pix platform, they remain responsible for any prior use.

5. User Account

The user account creation process includes the following steps.

Step 1. The user fills in a form on the Pix platform.

The form indicates the mandatory data required to create a user account (first name, last name, email address, password).

The user must provide a valid email address, which in particular will allow the sending of a confirmation email for account creation if necessary (especially in case of password change). In addition, they must choose a password matching the following criteria:

  • At least 8 characters including at least one lowercase letter, one uppercase letter, and one number.

The user must validate, by checking a box for this purpose, that they accept the terms of use of the Pix platform.

Step 2. The user logs into their user account using their login credentials, which are personal and confidential.

The user is solely responsible for preserving and keeping their password confidential and, consequently, for any consequences of any inadvertent disclosure to others.

Any use of the user account with the password assigned to the user is presumed to originate exclusively from the user.

The user agrees to promptly notify in case of theft of their password or any use by a third party they become aware of. This notification must be sent using a contact form adapted to the user’s profile available at: https://pix.fr/support.

It is possible to reset the password via the user account by clicking on the "Forgot password?" link and entering their email address. An email will be sent to the user, allowing them to set a new password, which must also comply with the above criteria.

6. Access to the Platform

Access to the site is free, especially for viewing general informational content.

However, some parts of the Pix platform are accessible only to users with a personal account and password, according to the terms and conditions specified on the online registration form and these general terms of use.

The Pix platform is normally accessible 24/7, subject to suspensions, in particular for maintenance purposes, at the discretion of GIP Pix.

The user guarantees the accuracy of the information provided for registration purposes.

Due to the nature and complexity of the internet, especially its technical performance and response times for viewing, querying, or transferring data, GIP Pix will make every reasonable effort, in accordance with best practices, to allow access to and use of the Pix platform. However, GIP Pix cannot guarantee absolute accessibility or availability of the site or services.

GIP Pix cannot be held responsible for the user’s computer equipment or internet access functioning properly.

7. Technical Requirements

GIP Pix informs the user of the following technical prerequisites necessary for the proper functioning of the Pix platform and services:

  • a recent web browser (Firefox, Edge, Chrome, Safari) not older than 2 years;
  • a satisfactory internet connection.

8. Security

Any unauthorized access to the Pix platform is prohibited and may be subject to criminal penalties.

A user without a personal user account must not access another's personal account and must not attempt to enter or attempt to enter a space that is not theirs. Such access may be  considered fraudulent access under the provisions of the Penal Code.

If the user  enters such a space without right, accidentally, they must notify GIP Pix through a form available at: https://pix.fr/support

The user agrees to treat as confidential all data they become aware of as a result of accessing another's personal space and to not disclose it.

GIP Pix uses its best efforts to secure the Pix platform in view of the complexity of the Internet. It cannot guarantee absolute security.

The user may inform GIP Pix of any fault in their user account via a contact form adapted to their profile at the following address: https://pix.fr/support.

The user agrees to take all appropriate measures to protect their data and/or software and/or devices from any virus contamination on the internet.

The user agrees to only use their user account and services and, more generally, the Pix platform, under the conditions defined in these terms and, furthermore:

  • not to misuse their user account for purposes contrary to the normal use of the services;
  • not to commit any act of infringement.

The user is responsible for their use of their user account and the services and, more generally, their use of the Pix platform. They agree to use the user account in good faith, in compliance with these terms, applicable laws and regulations, particularly those relating to intellectual and industrial property, personal data protection, and privacy.

9. Maintenance and Support

9.1 Support

GIP Pix provides purely technical support to the Pix user, who, where appropriate, is responsible for reporting any service malfunctions detected.

The user can contact Pix technical support via a contact form adapted to their profile on the site https://pix.fr/support.

9.2 Developmental Maintenance

Services may evolve over time, to take account of technological changes and user needs.

GIP Pix can update the services at any time.

Unless otherwise agreed with GIP Pix, GIP Pix reserves the right at its sole discretion, without notice or compensation, to temporarily or permanently close the site or restrict access to one or more services, in particular for updates, maintenance, modifications, or changes to operational methods, servers and access times, without this list being exhaustive.

GIP Pix is not responsible for any damage of any kind that may result from these changes or from a temporary unavailability or permanent closure of any or all of the site or associated services.

GIP Pix reserves the right to add to or modify the Pix platform and, if applicable, the services available, at any time in line with technological change.

It is the user's responsibility to upgrade their equipment (hardware and software, such as operating system or browser updates) at their own cost, if the evolution of services reasonably requires it, to comply with technological standards.

10. Responsibility

10.1 User Responsibility

The user accesses and uses the Pix platform at their own risk and under their responsibility, in accordance with French law in force and any applicable mandatory public law, as well as these terms.

The user is exclusively responsible for the lawfulness of any data they provide for accessing and using the Pix platform.

The user is solely responsible for activity carried out from their access to the Pix platform.

The user agrees not to disrupt the access and/or use of the Pix platform by other users and not to access third party user accounts.

Any operation carried out on the Pix platform with the user's login credentials is deemed to be carried out on the user's behalf and under their responsibility.

The user agrees not to commit any act that could compromise the ICT security of GIP Pix or other users, in accordance with the "Security" section.

The user agrees not to interfere with or disrupt the normal functioning of the user account or, more generally, the Pix platform.

The user will compensate GIP Pix, in case of complaint, action, lawsuit, or conviction resulting from any non-compliance with these terms of use, under standard legal conditions.

10.2 GIP Pix Responsibility

GIP Pix will endeavor to ensure the general quality and relevance of the information provided.

GIP Pix will strive to carry out tasks related to the user account that are its responsibility.

GIP Pix cannot be held responsible for the quality of the services, as these are offered "as is", which the user accepts.

Furthermore, GIP Pix cannot be held liable:

  • in case of temporary or total unavailability of any or all access to the Pix platform and, more generally, any lack of performance whatsoever;
  • for inability to access the Pix platform, due to destruction of equipment, hacking or cyberattacks, deprivation, deletion or prohibition, temporary or permanent, for any reason, to access the internet;
  • within the limits of applicable law, for any indirect damages, including but not limited to loss of profits, data, or any other intangible assets, caused by use or, conversely, by inability to use the Pix platform;
  • in case of malfunction, inaccessible access, misuse, improper computer or device configuration by the user, or the use of a rarely used browser or operating system by the user;
  • in case of fraudulent or abusive use or voluntary or involuntary disclosure of the login details entrusted to the user to any third party.

This clause remains applicable in the event of invalidity, cancellation, termination, or nullification of these terms.

11. Intellectual Property

GIP Pix is, and remains, the exclusive owner of protected elements and those not subject to a free license on the Pix platform under the provisions of the Intellectual Property Code.

GIP Pix’s ownership in particular includes all documentation, the databases of the Pix platform, and their interfaces, including tests, without this list being exhaustive.

These terms do not have the effect of transferring or assigning the intellectual property rights of the Pix platform or the services to the users.

As a consequence, users may not take any action or perform any act that could, directly or indirectly, infringe the intellectual property rights of GIP Pix or third parties, or these terms. Notably, they must not modify, copy, reproduce, download, disseminate, transmit, commercially exploit and/or distribute in any way the site, the services, the tests, informational content, data not provided by them, or the Pix platform, without prior permission from GIP Pix.

The user is strictly prohibited from any unauthorized reproduction of the tests or test items available on the site. 

Any reproduction, disclosure, publication of test items alone or with associated answers, in any form whatsoever (especially on the internet, such as on blogs, social networks, etc.), constitutes a serious breach of these general terms of use, seriously harming the public mission of GIP Pix, the intended purpose and reliability of the service, the image of GIP Pix, their intellectual property rights, and equality among users.

Only use in accordance with the stated purpose of the Pix platform is authorized. Any unauthorized or non-expressly authorized use by GIP Pix under these terms is unlawful.

Trademarks and distinctive signs belonging to GIP Pix and its partners, such as domain names, trademarks, names, and logos appearing on the website are protected by the Intellectual Property Code. Any full or partial reproduction of these distinctive marks from site materials without the express permission of GIP Pix is therefore prohibited.

Furthermore, use of third-party artificial intelligence or any other software (program, script, automated mechanism, etc.) to extract data, scan, analyze content, collect information, or transmit information to the Pix platform, on Pix websites (unless the service itself expressly invites a user to do so within a test) is strictly forbidden.

12. Hyperlinks

GIP Pix reserves the right to set up hyperlinks on the Pix platform leading to web pages other than its own site or the Pix platform.

GIP Pix disclaims any responsibility for the content provided on these sites through activation of such hyperlinks. Each user accesses third-party sites entirely at their own risk.

Setting up a hyperlink on a third-party website redirecting to any Pix platform web page, except for site pages, requires prior written authorization from GIP Pix.

13. Personal Data

In its dealings with users, GIP Pix, as data controller, may process the following personal data of a user: surname(s), first name(s), email address, login credentials, Pix application data (test responses, test results), and connection logs. 

Processing of this data is carried out for GIP Pix's purposes, under conditions set out in its Personal Data Protection Policy, which the user declares to have accepted and read at the time of account creation.

14. Termination of Services

14.1 Unsubscription and Deactivation

Access to the user account remains effective as long as the user logs in to the Pix platform and uses the services.

A user can unsubscribe from the Pix service by making a request via a contact form tailored to their profile on the site: https://pix.fr/support.

When a user has not logged in or used their account for a period of five (5) years, GIP Pix may archive the user's data for five (5) years and reactivate their account at their request.

14.2 Suspension and Exclusion

In case of breach of these terms by the user, GIP Pix reserves the right, without compensation, to suspend access to the platform until the reason for suspension is resolved.

In case of repeated or serious breach of these terms by the user, GIP Pix reserves the right, without compensation, to terminate the user's registration and access, end their user account, or restrict access to some or all of the services, without prejudice to any legal action that may be taken.

15. Evidence Agreement

Online acceptance of these terms and conditions by electronic means is, between the parties, as valid as a written agreement on paper.

Computer records kept in the IT systems of GIP Pix will be kept under reasonable security conditions and considered as proof of communications between the parties. This technical evidence is valid unless proven otherwise, by presumption.

Archiving and hosting of the Pix platform's terms of use are carried out on a reliable and durable medium that can be produced as evidence, substantially the same as technical logs showing user acceptance.

16. Severability

If one or more provisions in this contract are found to be invalid or declared as such by application of a law, regulation or final decision by a competent jurisdiction, the other provisions will remain in full force and effect.

17. Time Limitation

Any action, claim, or legal demand related to use of the services, the site, or the platform may only be brought by the user within two years from the day they knew or should have known the facts allowing them to do so. This is particularly the case regarding the taking of a certification.

18. Governing Law

This contract is governed by French law.

This applies to substantive and procedural rules, regardless of where the substantive or ancillary obligations are performed.
